Our terms of service define the rights, responsibilities, and usage conditions governing access to and use of the eFACiLiTY® platform.

These Terms of Service (“Terms”) govern your access to and use of the eFACiLiTY® website, applications, software, APIs, and related services (collectively, the “Services”) provided by SIERRA ODC Private Limited (“eFACiLiTY®”, “we”, “us”, or “our”).
eFACiLiTY® is an enterprise-grade Integrated Workplace Management System (IWMS) and Computer-Aided Facility Management (CAFM) platform developed by SIERRA ODC Private Limited to support campus facility and workplace operations.
These Terms of Service explain the framework under which organizations access and use the eFACiLiTY® platform. They are designed to ensure that the platform operates with clear governance, security, and operational accountability.
For our enterprise customers, these Terms reinforce a few important principles:
These terms establish the framework under which SIERRA and customer organisations access and operate the platform securely and responsibly.
For organisations using eFACiLiTY®, these Terms support a secure, predictable, and well-governed service relationship:
Services: The enterprise facility and workplace management solutions provided by eFACiLiTY®, including its integrated IWMS and CAFM platform and related functionalities, modules, applications, and services, as may be made available to the Customer pursuant to a formal agreement.
Website: The eFACiLiTY® website is used to access information about the Services and to initiate enquiries or onboarding.
Customer: The organisation that enters into a commercial agreement with SIERRA ODC Private Limited for the use of the Services.
User Data: Any data, information, or content submitted, uploaded, or generated by Customer or its authorized users through the Services.
Authorised Users: Individuals permitted by the Customer to access the Services under its account.
By accessing or using the Website or Services, including completing a sales consultation and implementation process, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Website or Services.
The Website is provided for informational purposes, including learning about eFACiLiTY® and initiating contact. Use of the Website does not grant access to the Services. We do not guarantee uninterrupted availability of the Website and may modify or withdraw it at any time.
Access to the Services is provided only after completion of a formal sales, contracting, and implementation process. The Services are intended solely for business and enterprise use and not for personal or consumer purposes.
User accounts are created as part of the implementation process. Customer is responsible for managing authorised users and access rights.
Customer is responsible for maintaining the confidentiality of all login credentials and for activities conducted under its account. Any unauthorised use must be reported immediately.
eFACiLiTY® supports Multi-Factor Authentication (MFA) as part of its access security systems. MFA is mandatory for administrative and designated high-risk user roles, subject to system configuration and customer security policies.

Access to the Services is subject to commercial terms as agreed under a signed contract. Fees, billing cycles, and payment terms are governed by the applicable signed agreement between both parties. Late or non-payment may result in suspension or termination of access. Customer is responsible for all applicable taxes.
Data Ownership: Customer retains full ownership of all User Data. eFACiLiTY® does not claim ownership over Customer data.
Data Processing: eFACiLiTY® acts as a data processor and processes User Data solely for the purpose of providing and improving the Services, in accordance with applicable data protection laws and the Privacy Policy.
Security Measures: eFACiLiTY® maintains a defined information security program, which includes periodic vulnerability assessments and penetration testing conducted as part of its security testing cycle using industry-standard tools and methodologies.
Incident Response: eFACiLiTY® maintains an incident response process aligned with applicable data protection and security regulations, including GDPR where applicable. In the event of a security incident involving personal data, eFACiLiTY® will act in accordance with applicable legal and contractual obligations.
Confidentiality: Each party agrees to keep confidential any non-public, proprietary, or confidential information received from the other party and to use such information only as necessary to perform under these Terms.
All rights, title, and interest in the Services, including software, documentation, and related intellectual property, remain the property of eFACiLiTY® or its licensors. Subject to these Terms and applicable agreements, you are granted a limited, non-exclusive, non-transferable licence to use the Services.
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, eFACiLiTY® disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, eFACiLiTY® shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Liability, if any, shall be limited as set out in the applicable commercial agreement. Nothing in these Terms limits liability for death or personal injury caused by negligence or for liabilities that cannot be excluded by law.
Access to the Services may be terminated or suspended in accordance with the applicable agreement, including for breach of these Terms or non-payment. Upon termination, Customer’s right to access the Services will cease, subject to data handling provisions defined contractually.
We may update these Terms from time to time. Material changes will be communicated where required by law. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.
